BY ACCEPTING THIS AGREEMENT YOU AGREE TO BE BOUND AND HELD BY THE TERMS BELOW. YOU ARE ENTERING A MEMBER ("member" or "Member") AGREEMENT WITH EPRAIRIE, INC. ("ePrairie").
House Rules :
ePrairie has carefully developed the following rules to promote the free-flowing exchange of ideas about your interests, activities and hobbies, while maintaining standards consistent with the Internet community and the societies of the world. If you have any questions regarding these guidelines, please contact us at help@ePrairie.com.
Please refrain from using your ePrairie account for the following activities:
1.Displaying material that is pornographic, obscene, nude, graphically violent, and other inappropriate images.
2.Displaying defamatory, libelous, hateful, pornographic, profane or obscene language.
3.Providing material that is grossly offensive to the online community, including blatant expressions of bigotry, prejudice, racism, or hatred.
4.Creating offensive and indecent member names, screen names, or handles.
5.Harrasising another member online.
6.Solicitation of gambling.
7.Disrupting the flow of a discussion by repeatedly posting the same message or image, or by posting excessively large images.
8.Impersonating others, including but not limited to, an ePrairie employee, representative or host.
9.Displaying material that exploits children under 18 years of age.
10.Promoting or providing instructional information about illegal activities, promoting physical harm or injury against any group or individual, or promoting any act of cruelty to animals; This includes, but is not limited to, the following activities: Providing instructions on how to assemble bombs, grenades and other weapons; Disseminating personal information about another individual for malevolent purposes; Providing computer software viruses or software designed to create a virus; Providing satellite TV cracks; Providing programs to create a denial of service attack against another individual or ISP; Facilitating the delivery of "spam" e-mail; Soliciting passwords from other members.
11.Committing acts of copyright, trademark, patent, trade secret or other intellectual property infringement; This includes, but is not limited to, the following activities: Providing pirated computer programs or links to such programs (this also includes files which are solely intended for game emulation); Providing information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs; Providing any type of cracker utility; Providing pirated music or tablature or links to such files.
12.Developing home pages or session posts that consist of hyperlinks to content not allowed in ePrairie.
13.Having multiple ePrairie accounts that are within the same ePrairie site or substantially refer to the same unique individual; Each ePrairie account allows that particular individual access to any of the sites on the ePrairie network; any individual found registering more than one account or creating false accounts to improve contest winning odds or for any other reason may be removed from the ePrairie site network without prior warning.
14.Using ePrairie for the purpose of gathering personal identifying information from individuals for commercial or unlawful purposes.
15.Posting or disclosing any personal identifying information belonging to children [Kids, if you are under the age of 18: For your safety, please do not put your real name, address, phone number, e-mail address or other personal identifying information in any of the ePrairie sites or give it to strangers] KIDS UNDER 13 ARE NOT PERMITTED TO REGISTER ON THE EPRAIRIE SITE NETWORK.
16.Violating Internet standards for the purpose of promoting your user account.
17. Engaging in commercial activities without registering as an ePrairie Commercial Account. This includes, but is not limited to, the following activities: Offering for sale any products or services; Soliciting for advertisers or sponsors; Conducting raffles or contests that require any type of entry fee; Displaying a sponsorship banner or link of any kind, including those that are generated by banner or link exchange services, with the sole exceptions of the Internet Link Exchange; Displaying banners for services that provide cash or cash-equivalent prizes to users in exchange for hyperlinks to their websites; Promoting, soliciting or participating in multilevel marketing or pyramid schemes.
ePrairie may elect at its sole discretion to monitor some, all, or no areas of the ePrairie network for the adherence to these house rules or other house rules that may be published in the future. You acknowledge that by providing you with the ability to distribute your content, ePrairie is acting as a passive conduit for such distribution and ePrairie is not undertaking any obligation or liability relating to any content or activities.
It is ePrairie's policy to respect the privacy of its members. Users acknowledge that ePrairie may disclose member information to third parties as described in our Privacy Policy. ePrairie reserves the right to edit or disclose the contents of your private communications to law enforcement authorities, if in ePrairie's good faith belief that such action is reasonably necessary to: a) conform to the edicts of the law or comply with legal process served on ePrairie; b) protect and defend the rights or property of ePrairie; or c) act under exigent circumstances to protect the personal safety of ePrairie's members or the public.
ePrairie is not responsible for any user-generated content. We reserve the right to remove any homepages or other user generated content that are in violation of the Terms of Service, House Rules, or any other content standards, including, but not limited to discussion board standards. Members are legally responsible for their content and must not use copyrighted material, or post material considered indecent for minors.
You and any person who has access to your Account must evaluate, and bear the risk associated with, the accuracy, completeness, or usefulness of any message, information, text, data or other materials. ePrairie reserves the right to remove material which is deemed in ePrairie's sole discretion unlawful, harmful, defamatory, hateful, offensive, or otherwise objectionable in violation of the house rules or any rules or policies which ePrairie has in place at the time. ePrairie may also edit any material submitted by a member for the purpose of conforming the material to meet the rules of ePrairie, clarifying submitted material, or any other legitimate lawful reason. Member agrees not to use ePrairie for chain letters, junk mail, unsolicited bulk mail, or any type of spam.
ePrairie is not responsible or liable for any loss of data resulting from our deletion of user data or as a result of network or system outages, file corruption or any other reasons. We urge all members to maintain backup versions of their home pages to guard against losses of any kind.
You or ePrairie may terminate your Account at any time for any reason or no reason at all. Once your Account is terminated, you can not engage in member activities on ePrairie without the express written consent of ePrairie, and you can not assist in enabling a terminated member access to ePrairie using your Account. In cases where you have allowed any other individual to use you Account or have negligently made your password publicly available, you recognize that you are fully responsible for: a) online conduct for such user; b) controlling the users access to and use of ePrairie; and c) the consequences of any misuse. You further recognize that you, as the holder of the Account, are entirely responsible for activities conducted through such Account.
Members who are in violation of the ePrairie Membership Terms of Service or Content Guidelines may have their membership revoked, services cancelled , and their information, or portions of their information, suspended or removed without warning, in which event ePrairie will not return the removed information or website to the offending member.
EPRAIRIE RESERVES THE RIGHT TERMINATE ANY MEMBER FOR ANY REASON OR NO REASON AT ALL.

ePrairie Membership Terms of Service:
PLEASE READ THESE TERMS AND CONDITIONS OF USE carefully before using any ePrairie site. By using any ePrairie site, you signify your assent to these terms of use. If you do not agree to these terms of use please do not use any ePrairie site. We reserve the right, at our discretion, to change, modify, add, or remove portions of these terms at any time. Please check these terms periodically for changes. Your continued use of ePrairie following the posting of changes to these terms (including the house rules, privacy policy, any other standards including but not limited to, discussion board standards) will mean you accept those changes.
1. Access to the ePrairie network of sites is available to persons 13 years of age or older. ePrairie reserves the right to deny, suspend, or revoke any membership (without prior notice) in the event that ePrairie learns that a member or person seeking membership is under the age of 13.
2.The opinions and views expressed in any area of the site supplied by user generated content do not reflect the opinions and views of ePrairie and are not reviewed in any way before they appear in ePrairie.
3.ePrairie is not responsible for the content of any user-generated content. ePrairie serves a network where people can meet other people and takes no responsibility for the content generated amongst private or public conversations between individual members. Members are solely responsible for everything contained in their postings and interactions with the ePrairie sites. ePrairie does not verify, endorse or otherwise vouch for the contents of any user generated content. Members may be held legally liable for the content they generate and may be held legally accountable if their content includes, for example, defamatory comments or material protected by copyright, trademark, patent or trade secret law without the express permission of the author or owner.
4.ePrairie is not responsible for the delivery of any goods or services sold or advertised through its sponsors or its members.
5.ePrairie does not actively monitor user generated content areas but will investigate complaints of a violation of the ePrairie Content Guidelines and Terms of Service. Please submit any such complaints to complaints@ePrairie.com.
6.The member agrees to indemnify and hold harmless ePrairie for any loss, liability, claim, damage, and expenses (including reasonable attorneys' fees) arising from or in connection with the member's content or use of the member's ePrairie e-mail account.
7.ePrairie is not responsible or liable for any loss of data, nor is it required to return any data, resulting from our suspension or deletion of member user accounts, network or system outages, file corruption or any other reasons. We urge all members to maintain backup versions of their information to guard against losses of any kind.
8.By uploading materials to any section or submitting any materials to us, you automatically grant (or warrant that the owner of such as expressly granted) us perpetual, royalty-free, irrevocable, non-exclusive right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute such materials or incorporate such materials into any form, medium, or technology now known or later developed. In addition, you warrant that all 'moral rights' in those materials have been waived.
9.Search and directory are services offered by ePrairie. ePrairie explicitly disclaims any responsibility for the content or availability of information contained in our search index or directory. ePrairie also disclaims any responsible for the completeness or accuracy of any directory or search result.
10.ePrairie sites contain links to other sites not under ePrairie's control. ePrairie explicitly disclaims any responsibility as to the content of any other site not under our control and is not responsible to investigate, check, or endorse any site not on the ePrairie network.
ePrairie Credit Card Refund Policy:
No refunds are given for products and services charged by credit card via ePrairie.com. If you are unhappy with a particular product or service, you can e-mail info@eprairie.com and we may grant credits for equal or lesser amounts on a case-by-case basis. Refund policies for products and services purchased from our affiliates adhere to the refund policies of our respective affiliates.
Intellectual Property Dispute Policy:
In the event that ePrairie receives a complaint that a member's generated content allegedly infringes intellectual property rights or is otherwise unlawful, ePrairie may request written substantiation of the complaint from the complaining party, for example, substantiation of proof of ownership in the form of a trademark, service mark, patent or copyright. ePrairie will take the steps it believes to be appropriate under the circumstances, including, for example:
1.Suspending the site, or a portion of the site, immediately until the dispute is resolved;
2.Providing the member with contact information for the complaining party;
3.Instructing the member to contact the complaining party to resolve the dispute;
4.Informing the complaining party of our actions and ask that party to work directly with the member;

5.Taking the following action based on the progress of the dispute:
If the member has not pursued resolution within 30 days of a notification, the site, or portions of the site, will be deleted; If the complaining party has not pursued resolution within 30 days of the member's response, the site, or portions of the site, will be re-activated; If legal action is pending or the dispute is not settled, the site, or portions of the site, may remain suspended until resolution is reached and ePrairie is notified by both parties as to the outcome; If a resolution is reached between the parties, the site, or portions of the site, will be reactivated with any mutually agreed upon modifications. If a copyright, trademark, patent, or other infringement is obvious (such as when pirated computer programs or information used to circumvent manufacturer-installed copy-protect devices, including serial or registration numbers for software programs or any type of cracker utility, is being distributed), ePrairie also reserves the right, instead of following the above stated procedures, to delete all files and remove the member without any warning.
Other Rights Reserved:
ePrairie also reserves the following rights:
To amend or change the ePrairie House Rules or Terms of Service at any time and without notice; To release current or past member information if ePrairie believes that a member's account is in violation of the ePrairie House Rules or Terms of Service, is being used to commit unlawful acts, if the information is subpoenaed and/or if ePrairie deems it necessary and/or appropriate; To deny membership to serious or repeat offenders of the ePrairie Membership Terms of Service or House Rules; To remove members for conduct that ePrairie believes is harmful to other members, to non-members or to ePrairie as a business; To remove members who interfere with the design and operation of ePrairie devices, without warning; To utilize third parties to provide services to ePrairie members. These third parties may require limited access to members' personal identifying information in order to perform the services. Notice may be given to members of the need to share information at the point of collection or a reasonable amount of time before sharing begins; To use images of member submitted content for promotional and other commercial purposes.
